Thank you for choosing Fresh Web Design.
We know that Terms of Service aren’t the most exciting thing you’ll read today, so we’ve tried to keep ours as clear, straightforward and jargon-free as possible.
These terms explain how our website subscription service works, what you can expect from us, and what we ask from you in return. They form the agreement between Fresh Web Design (“we”, “us” or “our”) and you (“you”, “your” or “the client”) when you subscribe to one of our website plans.
If anything isn’t clear, please don’t hesitate to ask. We’d much rather answer a question than have something misunderstood.
These Terms of Service are intended to explain how we work in clear, straightforward language. They don’t affect your statutory rights under UK law.
By subscribing to our services, you agree to these Terms of Service.
1. Our Promise to You
At Fresh Web Design, we believe good service is about more than just building websites.
When you become a customer, we’ll always aim to:
- Design your website with care and attention to detail.
- Treat your business as if it were our own.
- Explain things in plain English.
- Keep your website secure and up to date.
- Respond to support requests as quickly as reasonably possible.
- Never carry out chargeable work without discussing it with you first.
- Be honest, transparent and fair in everything we do.
We believe great long-term relationships are built on trust, not small print.
2. About Our Subscription Service
Fresh Web Design provides professionally designed websites on a simple monthly subscription.
Instead of paying a large upfront fee for your website and then paying separately for hosting, maintenance and support, everything is combined into one straightforward monthly payment.
Depending on the subscription you choose, your plan may include:
- Professional website design and build
- Secure UK hosting
- SSL security certificate
- Business email accounts
- Ongoing website maintenance
- Software and security updates
- Website backups
- Minor content revisions
- Friendly UK-based support
The exact features included with your subscription are shown on our website at the time you sign up.
As technology changes, we may occasionally improve or update the services we provide. If any significant changes affect your subscription, we’ll always let you know in advance.
3. Your Subscription
Your subscription begins on the date your first payment is successfully received.
All Fresh Web Design subscriptions have an initial 12-month minimum term.
This allows us to spread the cost of designing and building your website while keeping your monthly payments affordable.
We will supply our bank details so you can set up the STO or DD for the payments.
After the initial 12-month period, your subscription will automatically continue on a rolling monthly basis unless cancelled by either party in accordance with these Terms.
4. Payments
Subscription payments are made monthly in advance using the payment method you provide when signing up.
Payments are collected automatically on the same date each month wherever possible.
All prices shown on our website are in Pounds Sterling (£). Where VAT is applicable, this will be clearly shown before payment is made.
If we ever need to review our subscription prices, we’ll always give you at least 14 days’ notice before any changes take effect.
5. Missed Payments
We understand that payment issues occasionally happen.
If a payment cannot be collected, we’ll normally try again and notify you so the problem can be resolved quickly.
If payment remains outstanding, we may temporarily suspend some or all of your services until your account is brought up to date.
If an account remains unpaid for more than 14 days, we reserve the right to suspend your website, email services and hosting until payment has been received.
Should payment still not be made after reasonable attempts to contact you, we may terminate your subscription and remove your website from our servers.
We sincerely hope this is something we’ll never need to do.
6. Refunds
As your subscription covers professional services that begin soon after your order is placed, subscription payments are generally non-refundable.
If you’ve asked us to begin designing or developing your website, any work already completed cannot usually be refunded.
Nothing in these Terms affects your legal rights under UK consumer law.
7. Working Together
Building a successful website is a partnership.
We’ll look after the technical side of things, but we’ll also need your help from time to time.
You agree to provide:
- accurate business information;
- text, photographs, logos and other content needed for your website;
- feedback and approvals within a reasonable timeframe;
- any licences or permissions needed for content you ask us to publish.
Delays in receiving content or approvals may delay the completion of your website.
8. Your Content
Everything you provide for your website remains yours.
This includes things like:
- your logo
- photographs
- written content
- branding
- videos
- documents
- downloadable files
You confirm that you own these materials or have permission to use them.
Fresh Web Design cannot accept responsibility for copyright or licensing issues relating to content supplied by clients.
9. Fair Use
Our subscriptions are designed for normal business use.
We ask that you use your website, hosting and email services responsibly and lawfully.
For example, you must not:
- send spam or unsolicited bulk emails;
- distribute malicious software;
- upload illegal or offensive material;
- attempt to compromise the security of our servers;
- use your website for unlawful purposes.
If misuse places our systems, other customers or our reputation at risk, we may suspend your services while the matter is investigated.
10. Before We Carry Out Additional Work
Your monthly subscription includes the services described on your chosen plan.
If you ask us to carry out work that falls outside your subscription, we’ll always explain this beforehand.
We’ll provide a quotation where appropriate, and we’ll never begin chargeable work without your agreement.
We don’t believe in hidden costs or unexpected invoices.
That’s one of the principles Fresh Web Design is built upon.
11. Hosting Your Website
Every Fresh Web Design subscription includes secure website hosting for the duration of your subscription.
We’ll take care of the technical side of things, including keeping your website online, maintaining the hosting environment and carrying out routine maintenance where needed.
Although we always aim to provide a reliable service, no hosting provider can guarantee 100% uninterrupted availability. Occasionally, planned maintenance, software updates, or circumstances beyond our control may temporarily affect your website.
If that happens, we’ll always do our best to restore normal service as quickly as possible.
12. Security & Website Maintenance
Looking after your website doesn’t stop once it’s launched.
As part of your subscription, we’ll regularly maintain your website by performing software updates, security checks, and general maintenance to help keep everything running smoothly.
We also perform routine website backups so that, should the unexpected happen, your website can usually be restored.
While we take every reasonable precaution to protect your website, no website connected to the internet can ever be guaranteed completely immune from security threats or technical failures.
13. Business Email Accounts
If your subscription includes business email accounts, we’ll set these up for you and help you get started.
Your email accounts are intended for normal day-to-day business communication with customers, suppliers and colleagues.
To protect our systems and other customers, email accounts must not be used for:
- sending spam or unsolicited marketing emails;
- mass email campaigns or newsletters;
- distributing malicious software;
- unlawful or offensive material;
- any activity that could damage the reputation of our email services.
If you need to send marketing emails or newsletters, we’ll be happy to recommend specialist services such as Mailchimp or similar platforms that are designed for that purpose.
14. Your Domain Name
Your domain name is your online identity.
For that reason, we strongly believe it should always belong to you.
You’ll typically register and renew your domain name through your provider of choice. We do sell domain names too if required.
Keeping your domain registration active remains your responsibility, but if you ever need advice or assistance, we’ll always do our best to help.
15. Monthly Revisions
One of the biggest advantages of a Fresh Web Design subscription is that your website doesn’t stand still.
Your subscription includes ongoing website revisions, allowing your website to grow and change as your business does.
Typical revisions include things like:
- updating text;
- replacing photographs;
- changing opening hours;
- updating prices;
- adding testimonials;
- publishing news or announcements;
- making small layout improvements.
If you ask us to carry out larger pieces of work – such as creating additional pages, adding new functionality, redesigning sections of the website or integrating specialist software—we’ll discuss this with you first and provide a quotation where appropriate.
We’ll never surprise you with unexpected charges.
16. Support
Need help?
Just get in touch.
Whether you’ve forgotten how something works, spotted a problem or simply have a question, we’re always happy to help.
Our normal support hours are Monday to Friday during UK business hours, excluding public holidays.
We’ll always aim to respond as quickly as we reasonably can.
While we can’t promise an immediate response every time, we pride ourselves on providing friendly, personal support rather than making you wait in a ticket queue.
17. Your Website Belongs to You
This is something we’re particularly proud of.
Many website subscription companies retain ownership of the websites they build, meaning customers can find it difficult or expensive to move elsewhere.
We believe there’s a better way.
Once you’ve completed your initial 12-month subscription, the website we’ve created for you becomes yours.
If you ever decide to move to another hosting provider after that point, we’ll provide your website files, database and the content you’ve supplied, making it as straightforward as reasonably possible for you to take your website with you.
Any premium software licences, third-party subscriptions or specialist tools that are licensed to Fresh Web Design rather than directly to you will need to be replaced if you move your website elsewhere. We’ll explain this clearly should the situation arise.
Our hope, of course, is that you’ll stay with us because you’re happy with our service—not because you’re tied into it.
If something isn’t quite right, we’d much rather have the opportunity to put it right than lose you as a customer. If you ever have concerns about our service, please let us know. We’ll always do our best to resolve things fairly and promptly.
18. Cancelling Your Subscription
Your subscription has an initial minimum term of 12 months.
After this period, your subscription simply continues on a rolling monthly basis to cover hosting, email accounts and any website revisions you require ongoing.
If you decide you’d like to leave, all we ask is that you give us 14 days’ written notice.
We’ll continue providing your services throughout your notice period.
19. Sometimes Things Take Longer
Most website projects progress smoothly.
Occasionally, however, delays happen because we’re waiting for photographs, written content, approvals or other information.
If this happens, we’ll simply pause the project until everything we need has been received.
We’ll always keep you informed and do our best to get things moving again as quickly as possible.
We’re on the same team, and our shared goal is to launch a website you’ll be proud of.
